Terms and Conditions of Use
General Terms
Use of our Gold Chat Room service is subject to our terms and conditions outlined below. You (also referred to in these terms as 'the User'), agree to abide by the following terms. Failure to abide by these terms may lead to your account being terminated, and in the case of copyright infringement, legal action. Chat-Forum.com reserve the right to modify these terms and conditions at any time and without notice. It is the users responsibility to check these terms on a regular basis to ensure compliance. Users will act in a responsible manner with regard to Chat-Forum.com network resources and are expected to remove chat room users found to be abusing these resources, for example, room flooding etc. Users must not use our chat rooms to promote or incite illegal or immoral behaviour or anything else deemed by Chat-Forum.com to reflect badly on the company.
Code Integrity & Placement
You will be sent an email containing your HTML for the chat room within 48 hours of us receiving cleared payment. You must not modify the supplied HTML code in ANY way, except where expressly permitted to set your own values, to do so constitutes a serious breach of these terms. Furthermore, you must not cover or obscure any part of the chat applet or associated components by means of frames or any other device including hiding of our copyright notice. If your chat code is not placed in a public area of your website will need to supply Chat-Forum.com support staff with valid login details to access the page containing the chat code.
Restrictions Of Use
We do NOT allow sites of the following nature to use our Gold Chat Room network. Users found in breech of this condition will have their account immediately deactivated. Types of sites not allowed in our network, at the sole discretion of Chat-Forum.com include illegal adult sites, hacking and phreaking, hate, racist, immoral or illegal content or related sites. This extends to the content of banner images and creatives. Chat-Forum.com reserves the right to cancel any account at any time. (Note: We DO allow LEGAL adult sites on our GOLD or PRO chat services because they do not contain advertising.)
Account Charges
Account charges for our Gold Chat Room service are as follows:
For the Annual Plan US$75.00 USD per year (paid in advance), we accept
payment using all major credit/debit cards or by check/bank transfer. You will be sent
an email reminder shortly before your account is due for renewal after a year. Your credit
card will NOT be automatically billed for your second year of service, you will need to
visit the payment page sent in the reminder email to renew your account.
For the Monthly Plan a one time set-up fee of US$15.00 and a monthly charge of
US$7.50 Your Credit/Debit card will be automatically debited monthly with confirmation
of this debit being emailed to you.
Indemnification
User shall defend, indemnify, and hold harmless Chat-Forum.com (ASCII Software Ltd) and its respective agents, affiliates, subsidiaries, directors, officers, and employees against any loss relating to or arising out of USER'S product or the content of any website delivered, including but not limited to materials that violate the right of a third party; materials that are defamatory or obscene; or materials that would constitute a criminal offence.
Chat-Forum.com is not liable to any claims, representation or warranties made by the User, including but not limited to the contents of their sites. Under no circumstances shall Chat-Forum.com be liable to Users for any loss, injury, or damage, of whatever kind of nature, resulting from or arising out of the chat program. Chat-Forum.com makes no warranties, either expressed or implied, concerning the performance and functionality of the chat program and hereby expressly disclaims all implied warranties, including warranties of merchantability or fitness for a particular use. Under no circumstances shall Chat-Forum.com be liable to Users for any loss, injury, or damage, of whatever kind of nature, resulting from or arising out of any mistakes, loopholes in the anti-fraud system, errors, omissions, delays, or interruptions in the receipt, transmission, or storage of any messages or information arising out of or in connection with the chat program.
Users guarantee that all content on their site is legal to distribute and that they own or have the legal right to use any and all copyrighted material.
